意大利知识产权概况

  在意大利市场投资的外国公司享有与本地公司相同的知识产权法律保护。受保护的知识产权涉及所有重要的领域,包括:专利商标、著作权以及外观设计。

  意大利遵守国际上主要的知识产权国际协定,作为知识产权国际协定的成员国之一,意大利将国际知识产权法律法规作为本国知识产权法的立法基础。

专利

  意大利法规规定,所有技术领域的任何发明,无论是新产品,还是新方法,均可获得专利。但对于人类或动物的诊断,手术和治疗方法,繁殖动物或培育植物的生物方法,不可授予专利权。申请专利应符合以下几个条件:

  1、工业实用性:可应用于一个或多个工业领域;

  2、新颖性:在专利申请日之前,发明未被任何个人(包括申请者自己)公开过;

  3、创造性步骤:该发明应体现出明显的技术进步,并且该技术对于相关工业领域的专业人员来说不是显而易见的。任何一项意大利专利的申请人为外国公民,巴黎公约成员国居民或WTO成员国居民的,其专利享有《巴黎公约》赋予的权利,保护期限为20年。

商标

  意大利商标法授予注册商标持有人商标专用权,商标持有人有权使用新的、合法的、有显著特征区别于其他图形标志,也有权根据《与贸易有关的知识产权法》(TRIPs)要求海关查封假冒商标货物。

  在意大利法律中,三维标识,音像和影像,组合色和原色调均可注册为商标商标一旦在意大利商标局(PTO)申请就享有保护。商标的有效期为自申请生效之日起10年,以后每十年续展一次,次数不限。在意大利,商品和服务的国际分类以《尼斯协定》为依据。 商标持有人可就商标所标识的全部或部分商品和/或服务进行转让或授予使用许可。意大利知识产权法对没有登记注册的商标也实行保护。

  于2011年7月11日在意大利专利商标局网站上颁布的公告Bollettino Marchi n.1包含所有2011年5月1日之后提交的商标注册申请,这些商标申请被宣布有资格注册并将有可能对即将提出注册申请的新商标提出异议。意大利专利商标局还公布了新异议程序使用的有关表格和操作办法,并已经开始生效。

  根据此新法令,如优先商标的持有者能证明某一个新的意大利商标的注册或某一新的指向意大利的国际商标的注册将导致与其商标混淆的危险,该优先商标持有者可以对这些新商标的申请的有效性提出异议。

  在意大利,商标异议是一个快捷,经济的行政手段,在许多情况下,可让您迅速解决有关商标混淆的争议。为使您的异议申请有效执行,我们建议您:

  1.在提交商标注册申请时提供一个不同于已使用过的符号的图形作为商标

  2.为已申请或注册的商标采取监视措施,以及时发现存在的商标混淆的危险。

  3.保存并准备好能证明商标被有效使用的文件记录。

版权

  意大利对版权的保护基于《保护文学艺术作品的伯尔尼公约》和意大利版权法。作者的原创作品从创作之日起就受到版权法的保护,并且不需要提出申请或履行其他程序。

  受版权保护的作品包括文学作品、动画、音乐作品、录音、软件、资料库、建筑作品及平面艺术。版权的保护期限为作者终生及其死亡后70年。

外观设计

  申请外观设计保护须具备以下条件:

  1、新颖性:在注册申请前该设计不为公众所知;

  2、原创性:对于一个见多识广的商标使用者而言,该设计应当显著区别于已知的其他设计。

  外观设计的保护期为自授权日起5年,可延展4次,每次延展5年,但总共不得超过25年。外观设计持有人享有专用权(包括制造、供应、进入市场、进口、出口),并有权制止任何第三方未经外观设计持有人同意使用该设计。

  Foreign companies investing in Italy enjoy the same legal IPR protections as local companies. These intellectual property rights cover all important areas, including patents, trademarks, copyrights and designs.

  Italy complies with the major international IPR agreements. As a member country of international IPR agreements, Italy regards these international agreements as legislative basis forIPR related laws.

Patent

  Italy prescribes that any invention in all technology fields, whether new products or new methods, can be patented. However, human or animal diagnostic and surgery and therapeutic treatment methods, as well as essentially biological methods for breeding plant or animal varieties cannot be patented. Patent applications have to meet the following requirements:

  1. Industrial application: the invention can be applied to one or more industrial sectors;

  2. Novelty: before the day of patent application, the invention has not been disclosed by any person (including the applicant);

  3. Inventive step: the invention should involve a clear technological progress, and the technological progress should not be obvious for person skilled in the related technological fields. An Italian patent enjoys the rights provided by the “Paris Convention” if the Applicant is a foreigner or resident in any state member of the “Paris Convention” or the WTO and has the duration of 20 years.

Trademark

  Italy’s Trademark Law grants trademark holder the exclusive right to use the sign.

  Trademark holders have the right to use the new, legitimate graphic signs that are distinguished from other commodities, and also have the right to ask customs to seize the counterfeiting goods according to the “Trademark-Related Aspects of Intellectual Property Rights”(TRIPs).

  In Italian Law, three-dimensional logo, audio & video, colour combination and chromatic shades can be registered as trademarks. After filing application with Italian Patent and Trademark Office(PTO), the trademark enjoys legal protection. The trademark validity is ten years from the date of application, and can be renewed every ten years with unlimited number of times. In Italy, the classification of goods and services is based on the “Nice Agreement”. Trademark owner may transfer or license the entire or part of the goods and services represented by the trademark. According to the terms of Italian IP code, unregistered trademarks can also enjoy protection.

  The Bollettino Marchi n.1 was published on the UIBM website on Monday, July 11, 2011, containing all the applications for trademark registration filed after May 1, 2011,which were declared to be qualified to be registered and against those which are now possible to lodge an objection. The Ministry has also published the available forms and operational mode for the new opposition procedure, which officially came into force.

  The owners of earlier marks may lodge opposition against new applications for registration of Italian trademarks and international registrations designating to Italy, demonstrating a risk of confusion with their trademarks filed or registered before.

  In Italy, the opposition is a new administrative tool, which is fast and economical and in many cases allows you to quickly resolve disputes concerning risks of confusion between marks.

  In order to allow the procedure of opposition to come into force, you are advised to:

  1. Provide a trademark which uses distinctive signs when making the application.

  2. Activate the surveillance service for your filed and registered trademarks.

  3. Prepare and maintain the records showing the use of your trademarks.

Copyright

  Copyright is based on the “Berne Convention for the Protection of Literary and Artistic Works” and on the Italian Copyright Law. The author’s original works are protected from the date of creation. The author can enjoy copyright protection without submitting an application or performing any other procedures.

  Copyright protected works include literary works, animation, musical works, sound recording, software, databases, architecture works and graphic arts.

  The duration of copyright protection is the author’s whole life and 70 years after his death.

Design

  To enjoy protection, a design shall meet the following conditions:

  1. Novelty: the design shall not be known to the public before the day of application;

  2. Originality: the design shall give informed users and impression which significantly different from other known designs.

  The protection period is five years from the application date and can be renewed for further five years four times. The total duration cannot exceed 25 year.

  The design owner enjoys the exclusive right to use (including manufacture, supply, market access, import and export), and has the right to stop any third party from using the design without the owner’s consent.
